$1.3 million: Four-Year Old Child Suffers Neurological Injuries in Auto Accident
A speeding semi-tractor trailer collided into a car severely injuring the young mother and four-year old daughter.
A young mother, Susie Smith, was driving with her young daughter, Jill Smith, after visiting with family during the aftermath of the South Florida hurricanes of 2004. As she proceeded into the intersection, a semi-tractor trailer traveling too fast crashed into their car, destroying her vehicle. Lifestar was sent to the scene, and mother and child were transported to the local trauma center for treatment of their extensive injuries.
While mom was in the hospital recovering from her substantial injuries, her young daughter was in the pediatric intensive care unit being treated for brain and other injuries sustained in the crash. Auto Accident Causes Significant Spinal Injuries that Results in Confidential Settlement for $1.35 Million.
On a rainy Tuesday afternoon, our client was driving from one job to another when he was rear-ended at a traffic light causing severe spinal cord injuries.
Steve Smith, a 40 year old landscape architect, was driving his work vehicle (a pickup truck with a hitch) from one job to another. While stopped at a red light, he was rear-ended by a van operated by a company employee and filled with air conditioning repair equipment. At the scene, Mr. Smith hoped he would feel better, but once the paramedics arrived, he was transported to a local emergency room and then transported to a trauma center with a suspected broken neck. Fortunately for Mr. Smith, his neck was not fractured. However, he did suffer severe trauma to his spinal column, resulting in significant herniated discs in his upper spine. Mr. Smith underwent a number of treatments of a conservative nature, specifically physical therapy. Prior to the crash, Mr. Smith had been an army ranger and was in excellent physical condition. He was an avid jogger, cyclist, and hiker. Following the crash, he was, of course, no longer able to do those activities, plus he was no longer able to meet the physical requirements of his job, despite his best efforts and his love for landscape architecture. As he went through conservative treatment, it became clear to his doctors that surgery would be required (including anterior cervical microdiscectomy). Mr. Smith had the first surgery and was hopeful that it would resolve all of his symptoms and his pain, but unfortunately, he had an unstable spine and required additional surgeries.
Mr. Smith sought the advice and counsel of Gary Roberts & Associates. Many efforts were made to resolve this case for Mr. Smith prior to filing formal litigation, but the insurance company was not cooperative. Litigation was filed, the matter was set for trial, and right before the trial began, a confidential settlement was reached.
